Instructions: Please prepare four pages long submission letter explaining why your client is eligible to file a refugee claim. You may assume some additional facts, but you need to specifically indicate that these are your assumptions. Also, please provide analysis for all four inclusion elements.
Scenario:
You have a potential client who came into your office who would like to file a refugee claim.
Mr. John Doecame to Canada as an international student. After completing his degree, he wanted to apply for a work permit. During his studies, John met Peter who was also gay. They developed a relationship and became very close. They have been dating for the last two years.
John comes from ABC Country, which recently introduced a bill C-166 which prohibits same sex relationships. It’s not clear what the punishment may be at this time, but John is seriously concerned about his safety if he goes back. The bill will come into force very soon and John believes that he won’t be able to go back to visit his family, as he was advised by his mother that some people will report John to local police.
The ABC country has a history of persecuting gays and lesbians. John has always been hiding his sexual orientation and never expressed his views openly towards same sex relationships. He once had an incident when he was 17 years old. He went with his friends to another region of his country to attend a social event. He was at the party where other kids have attacked him because they suspected him to be gay. They assaulted him and sexually harassed him. John didn’t tell his friends or anyone about this incident at the time, but now he knows that if he goes back, he will be persecuted. He was very open on social media about his sexual orientation while being in Canada.
